Divorce procedures are growing difficult for Rutherford, who stars in Gossip Girl. The actress has petitioned the court to restrain her husband from leaving the United States with their 2-year-old son, reports People.
Rutherford, 40, who is pregnant with the couple’s second child, filed for divorce from David Giersch last month, after two years of marriage.
Giersch and Rutherford are both asking for sole custody of the boy, with visitation rights for the other parent. Emergency papers were filed in court on January 9, asking for Giersch to be kept in the US with the boy.
