According to the website Femalefirst, Richie may be formally charged with driving while intoxicated. Last Wednesday, the California Highway Patrol recommended that the Los Angeles District Court handle the case.
If the District Court formally charges the Simple Life star, she may face jail time for the offence.
Last December 11, the 25 year-old woman was arrested for driving her car in the wrong direction on a California highway. Richie admitted to smoking marijauna before the incident. The celebrity was forced to pay a $15,000 bond before being released.
On February 7, Richie will appear in court on the charges.
