Wahlberg and his wife, Kim Fey, filed for divorce on August 13, reports People.
Fey cited irreconcilable differences and is asking for full, legal custody of their two sons, Xavier, 15, and Elijah, 7, along with visitation rights for Wahlberg.
Fey, 39, has also requested that the New Kids on the Block singer pay her alimony, as well as her legal fees.
The couple was married in August 1999 and separated last January.
