The Gossip Girl star is ready to face her ex-husband in court and obtain a restraining order against him, reports Starpulse.
Last year, the actress obtained a temporary restraining order against Daniel Giersch, the father of her two children, after accusing him of uttering threats and harassment.
She claimed that Giersch had begun to follow her, as well as her mother and nanny, and would randomly show up to threaten and frighten them.
She then filed for a restraining order for the first time, which was issued on September 25. Giersch had defended himself by denying the accusations of harassment.
Rutherford now wants a judge to hear her case, asking to testify against the German businessman. The hearing is set to take place tomorrow (January 13) in a Santa Monica court.
The couple, who filed for divorce in December 2008, is also battling for custody of their son Hermes, 3, and daughter Helena, 7 months.
