Madonna sued by another Material Girl

Clothing manufacturer has been using the name for a junior line since 1997.

You would think after all the time and money that went into the launch of pop icon Madonna’s fashion collection Material Girl, launched last fall with daughter Lourdes, someone would have trademarked the name to her popular 1985 hit song of the same name written by Peter Brown and Robert Rans.

A clothing company, L.A. Triumph, launched a juniors’ clothing line of the same name way back in 1997, and a year ago sued the singer’s company MG icon – owned by Madonna, her manager Guy Oseary, and the Iconix Brand Group Inc. – claiming they had infringed on their trademark, reports Coco Perez.

Madonna, 53, attempted to have the case thrown out of court as it’s obvious she and song’s writers popularized the name in 1985. However, a judge has recently allowed a lawsuit against the original Material Girl to proceed, and it may go to trial in mid-October.

L.A. Triumph is believed to hold trademark rights to the name, and is seeking monetary compensation, and for the mother of four to change the name her fashion collection.

This fall, Madonna and daughter Lourdes have expanded on the success of their Material Girl collection at Macy’s department store by adding cosmetics, lingerie and sleepwear, and upping the number of styles in denim, outerwear, and evening dresses.
