Nirvana wins its lawsuit against the baby of the cover of Nevermind

Spencer Elden took the band Nirvana to court, claiming that the image of him as a baby, where he was naked on the album Nevermind released in 1991, constituted abuse.

Elden, who was the baby on the cover in question, eventually bowed out of the lawsuit he filed (January 2022).

At the time, the family was paid $200 for the band to use the photo, and years later, Elden claimed that the image caused him permanent harm, The Guardian reported.

As a child, he was unable to give his consent for the photo to be used, so he recently returned to the case, asking for about $200,000 in damages.

In the end, U.S. District Judge Fernando Olguin dismissed the case because of the time lapse in the complaint, which was more than ten years old.

Nirvana argued that Elden had taken advantage of his status for personal and professional gain.
