A crucial Supreme Court victory for Donald Trump

On Monday, the U.S. Supreme Court handed a significant victory to former President Donald Trump by reinstating his presidential candidacy. This crucial decision nullifies efforts by some states, such as Colorado, Illinois and Maine, to exclude Donald Trump’s name from the ballot due to his involvement in the January 6 Capitol Hill riots perpetrated by his supporters.

At the heart of this legal dispute lies the interpretation of the insurrectionary clause of the 14th Amendment, this constitutional change, adopted following the Civil War, outlaws the eligibility of individuals involved in rebellion. The Colorado Court previously ruled that Trump had encouraged his supporters to attack the Capitol, thus applying the 14th Amendment to prevent a presidential candidate from appearing on the ballot for the first time in history.

The Supreme Court’s unanimous decision emphasized that states cannot use the Insurrection Clause against presidential candidates without direct Congressional approval.

This means that the decision will have implications for similar cases in the future.

The Court was divided on the scope of the decision. A majority of five out of nine justices held that the rule applies across the board, asserting that no state can exclude a candidate for federal office from the ballot. However, four justices felt that the scope of the decision should be limited to the specific case addressed by the Court, rather than applying broadly to all similar cases.

The Supreme Court’s decision comes at a defining moment in the contest for the nomination in several states, where Donald Trump is widely regarded as the leading favorite.

Donald Trump wants to deport Prince Harry

Former U.S. President Donald Trump, in a number of headline-grabbing statements recently, has expressed his vehement dislike of Prince Harry and his status… as an immigrant.

He has also declared that, if elected again in 2024, he would take no protective measures towards the Duke of Sussex, whom he would like to see deported as quickly as possible.

During his speech at the CPAC Republican convention in Oxon Hills, Maryland, Trump sharply criticized the Biden administration for its treatment of Prince Harry and Meghan Markle since their move to California in 2020. He described what he considers Prince Harry’s betrayal of Queen Elizabeth II as unforgivable , and suggested that the latter had received excessive courtesy from the US.

Trump’s comments come at a time when Prince Harry’s immigration status is under increasing scrutiny following his confession in his book Spare about his past drug use.

Getty Images

The Heritage Foundation, a conservative think tank, questioned the legality of Harry’s admission to the U.S. based on current immigration laws. Members of the Department of Homeland Security contradicted this, saying that not all statements in the books are considered fact or sworn evidence.

Simply put, Harry could not be denied access to America because of something in his book.

Trump’s comments aren’t limited to Prince Harry, however… he’s also targeted his wife Meghan Markle in several of his interviews and speeches.

Meghan and Harry must not feel too out of place to be publicly attacked in this way, as they’re used to it in England!

Trump ordered to pay $355M in civil fraud trial

The news is in. Former President Donald Trump has been ordered to pay $355 million (USD) at the end of his high-profile civil trial for fraud involving him and his company, the Trump Organization, as well as his son Eric, among others.

This is a heavy sentence for Donald Trump and his businesses, since the ruling could place him in serious financial difficulties.

It is a powerful verdict for the prosecution and for those who want to see Trump and his cronies held to account like all citizens, despite his status as a former president.

The Trump clan, meanwhile, described the verdict and sentence as a serious injustice, via a spokeswoman for the Republican presidential candidate’s legal team in 2024.

We now know the date of Trump’s criminal trial

The New York State Court is preparing to begin criminal court proceedings relating to allegations of bribery in a case involving Donald Trump, with jury selection scheduled for March 25.

Donald Trump’s legal troubles are gathering momentum, and this trial is of historic significance as the first criminal prosecution of a former U.S. president.

Manhattan State Court Judge Juan Merchan denied the former president’s motion to dismiss, paving the way for this historic trial. Trump was indicted on 34 counts of falsifying business records.

The charges assert that these acts were part of an elaborate scheme to conceal extramarital affairs.

The indictment claims that Trump made payments to Michael Cohen, his former lawyer. These payments were made to silence claims by Stormy and Karen McDougal that Trump had had an affair with them. Trump vehemently rejects these allegations. According to the indictment, payments to Daniels and McDougal were disguised as legal fees, including $130,000 for Daniels.

And that’s the real problem.

Falsifying business records is considered a Class E misdemeanor in New York and carries a maximum sentence of 4 years. If Trump is found guilty, given that this case was brought by the state, he will not be allowed to pardon himself in 2024 if he wins the presidential election.

Despite these legal problems, Donald Trump remains a serious contender for the Republican nomination for the 2024 presidential election.

According to some of the polls, he is the favorite against President Joe Biden.

In many key states, Mr. Trump is tied with or ahead of Mr. Biden.

Judge Merchan’s decision to pursue the case comes at a time of intense activity for Mr. Trump. He claims that his opponents are trying to undermine his comeback by bringing charges against him.

From March 25, then, the jury selection process begins, while the world will closely follow the progress of this historic court case, marking a new chapter in American legal and political history.

But first, let’s see how the Trump clan fares against prosecutor Fani Willis in Georgia… but that’s another story.

Biden says he wouldn’t run again if Trump wasn’t there

Joe Biden, President of the United States, has said in the past that his decision to run in 2020 would have been different if Donald Trump hadn’t entered the race, but he recently added to his comments, which surprised many, at a recent fundraiser in Boston, when he told Democratic supporters that he was only entering the race because Trump wanted to be re-elected.

Biden declared:

“If Trump wasn’t running, I’m not sure I’d run.”

Then he added:

“We can’t let him win.”

This is a rare revelation from President Biden in which he directly links his desire for a second term to the goal of stopping Trump’s political renaissance, and the statement caught many of his top political campaign officials and advisors off guard.

Joe Biden’s stance on Donald Trump’s candidacy is not unprecedented, since he has repeatedly portrayed Trump, particularly after Charlottesville, as a threat to American democracy. And the bizarre statements made during a Fox News town hall debate, broadcast live and hosted by Sean Hannity, in which the former president alluded to the possibility of him becoming a dictator should he win the election, only give further ammunition to Biden’s convictions.

Trump won’t be a dictator, “except on day one”

Former President Donald Trump once again sparked controversy during a televised Town Hall with Fox News host Sean Hannity, during an exchange in which he was asked about his past rhetoric and potential for abuse of power.

Hannity asked Trump a series of questions during the interview, but one in particular stood out:

“Under no circumstances, you are promising America tonight, you would never abuse power as retribution against anybody?”, Hannity asked, to which Trump replied:

“Except for day one.”

The former U.S. president’s response confused and prompted several questions, and was notably criticized by Biden’s campaign manager:

“Donald Trump has been telling us exactly what he will do if heā€™s reelected and tonight he said he will be a dictator on day one. Americans should believe him.”

It remains to be seen how Trump’s comments will affect his supporters or discourage undecided votes for the 2024 US elections!

Judge gags Trump: “He’s a criminal defendant”

Donald Trump could well face serious sanctions if he violates the ban imposed on him this Monday in the federal trial for his alleged attempts to nullify the results of the 2020 election, after the judge in the case issued her decision to impose a ban on any public comment aimed at prosecutors, court staff, as well as witnesses.

Trump is now very limited in what he can say about the federal prosecution of Special Counsel Jack Smith.

“His presidential candidacy does not give him carte blanche to vilify public servants who are simply doing their jobs,” explained Judge Tanya Chutkan when she issued her ruling.

Trump is no longer allowed to harass or threaten certain people, due to the restrictions imposed on him this morning, including Special Counsel Jack Smith’s staff, court personnel and numerous witnesses:

“Mr. Trump is a criminal defendant. He is facing four felony charges. He is under the supervision of the criminal justice system and he must follow his conditions of release.”

Judge Chutkan thus gave Trump and his lawyers a serious warning:

“Politics stops at this courtroom door.”

Donald Trump’s fraud trial begins in New York!

“No one is above the law.”

The civil fraud trial opened in New York on Monday, October 2, as Trump faces charges of overstating his businesses and properties.

Donald Trump is accused of falsely inflating the value of his business empire and his net worth by billions of dollars, in order to obtain better business contracts, financial loans and interest rates, among other things.

The details of these charges are overwhelming, as he is accused of persistent and repeated fraud, falsification of business records, conspiracy to falsify business records, publishing false financial statements, conspiracy to falsify financial statements, insurance fraud and conspiracy to commit insurance fraud.

Cameras were briefly allowed into the classroom before the court proceedings began, as Trump sat with his lawyers.

The judge has already ruled in the majority of this case, that Trump overvalued his businesses and properties for fraudulent financial gain, and declared:

“It’s a fantasy world… not the real world.”

Certainly harsh words about the management of Trump’s businesses by Donald Trump and his sons.

Trump, who was not required to be present at the opening of this civil trial, is banking on the publicity it will bring for his presidential campaign, but New York Attorney General Letitia James’ message before the trial is clear:

“My message is simple. No matter how powerful you areā€¦ No matter how much money you think you may haveā€¦ Nobody is above the law.”

Getty Images

The attorney general in the case is seeking $250 million in damages, banishment from serving as officers of a New York company and a five-year ban on business transactions, which would put an end to the Trump Organization.

Recall that the Trump Organization has developed and managed a wide range of real estate properties, including luxury condominiums, office buildings, hotels and resorts. Some of the most famous properties include the Trump Tower in New York and the Mar-a-Lago estate in Florida. The organization has operated Trump-branded hotels and resorts in various parts of the world. These properties are often associated with luxury and upscale accommodations.

Donald Trump was, in fact, the face of the organization for many years, but stepped away from day-to-day operations while President of the United States. His children, in particular Donald Trump Jr., Eric Trump and Ivanka Trump, played an important role in running the company.

Getty Images

Donald Trump Jr. and Eric Trump are also targeted in the fraud trial, while Ivanka Trump was cleared of all charges earlier this year.

The former President of the United States is expected to testify in his defense next week, while the trial is expected to last until December 22.

Again, Trump is found guilty of defamation against E. Jean Carroll!

Donald Trump has once again been found guilty of defamation against E. Jean Carroll, and a jury will be convened next January to determine the amount of damages, which will be added to the five million dollars already awarded to Carroll in the first trial she won last May.

In 2019, Carroll published a memoir entitled What Do We Need Men For? A Modest Proposal, in which she details various experiences with men throughout her life.

In it, Carroll alleged that Donald Trump sexually assaulted her in the dressing room of a Bergdorf Goodman department store in the mid-1990s. She claimed that Trump, at the time a real estate mogul and TV personality, had forcibly kissed and sexually assaulted her.

Trump vehemently denied the allegations and said he had never met Carroll, despite a photo showing them together at a social event in the 1980s.

Carroll filed a defamation lawsuit against Donald Trump in November 2019, claiming that he had falsely accused her of lying about the incident and damaged her reputation.

Getty Images

In October 2020, the US Department of Justice, under the Trump administration, sought to intervene in the trial and defend Trump, arguing that he was acting in his official capacity as president when he denied Carroll’s allegations, but to no avail. The trial finally took place last May.

At the conclusion of the civil trial, Donald Trump was found guilty of sexually assaulting Carroll in the 1990s (not guilty of rape) and of defaming her in comments made in 2019 and 2022.

In addition, now, the judge also allowed E. Jean Carroll to include comments made by Trump at a CNN Town Hall hosted by Kaitlan Collins last May, just days after she lost her case against Carroll, in the second case.

“This woman, I donā€™t know her. I never met her. I have no idea who she is. I had a picture taken years ago with her and her husband, nice guy John Johnson. He was a newscaster, very nice man. She called him an ape, happens to be African-American. Called him an ape… the judge wouldnā€™t allow us to put that in. Her dog or her cat was named vagina, the judge wouldnā€™t allow to put that in. All these things, but with her, they can put in anything… Access Hollywood,” the former president said.

The trial scheduled to determine the amount of damages will take place on January 15, 2024.
