Cottage Q&A: Inheriting the cottage and capital gains

My brother and I were given title to the family cottage as an early inheritance from our elderly father in 2020. The cottage was built in 1990. Our father chose to designate it as his principal residence as of 1994 and paid the capital gains for the period between 1990 and 1994 in his 2020 tax return. If and when my brother and I ever choose to sell the cottage, which had an MPAC assessed value of $550,000 in 2020, would the starting value for the capital gain be based on that $550,000 amount, or on the 1994 value of $135,000 that our father used in his 2020 tax return?—Harry V., Catchacoma Lake, Ont.

Neither value. The starting value for the tax calculation if and when you sell it will be the cottage’s “fair market value,” determined by the cottage’s sale price. That’s obviously not MPAC’s assessed value, and it’s not the historical FMV from 1994.

Getting an appraisal of the cottage’s value now if you don’t end up selling it for, say, five years, wouldn’t be useful. Market values are fluctuating, says Peter Lillico, a lawyer with Lillico Bazuk Galloway Halka in Peterborough, Ont. “The cost of the appraisal would just be money thrown away.”

How to use a combination of trusts to pass on the cottage

But it wouldn’t be a waste to calculate the cottage’s adjusted cost base now. (Math equation time! The adjusted cost base = the cost base, a.k.a. the value as of the date of purchase or inheritance + the value of the capital improvements since the date of purchase or inheritance.) To find this number, you’d get a historical appraisal to establish the cottage’s 2020 value—the cost base—and add the money you’ve spent on any capital improvements since acquiring the cottage—a new roof or an expanded dock, for example.

Then you and your brother “are loaded for bear,” says Lillico. The adjusted cost base is the amount you’d subtract from the sale price when you’re ready to sell in the future.

Succession lead Brian Cox sends congratulatory Cameo to Edward Rogers on electing preferred CEO

Warning: the article contains language some may find offensive.

Fans of Succession got to see a live-action version of the TV series when the Rogers board room drama started to make headlines last year.

The show focuses on a bickering family fighting for control over the family media empire — outlining many of the markings that made up the drama at Rogers.

The two worlds collided once again when a Cameo recording directed towards Rogers board chair, Edward Rogers, recently surfaced.

As first obtained and reported on by The Globe and Mail, Brian Cox, who plays the family patriarch in the fictional series, congratulated Edward Rogers for having his pick of CEO.

“Congratulations on your real-life succession at Rogers Communications. And also having Joe Natale to fuck the fuck off. Well done Edward. Congratulations,” Cox said during the 19-second video, ending it with a thumbs up.

The video is referring to Edward Rogers’ push to replace former CEO Joe Natale with his pick Tony Staffieri. His first attempt in September was unsuccessful.

The move led to pushback from a handful of board members, who Edward Rogers tried to replace without taking part in a shareholders meeting. This lead the company to challenge Edward Rogers on the legality of his actions, but a B.C. judge ruled the move was admissable.

Staffieri was eventually elected as interim CEO, ousting Natale. He was announced as the permanent president and CEO on January 11th.

Cox starts the video by saying “this is from Suzanne,” apparently referencing the chair’s wife, Suzanne Rogers.

Cameo is a website that allows people to purchase personalized messages from celebrities. According to the website, Cox charges $868 USD (roughly $1086 CAD) per video.

A spokesperson for Edward Rogers told The Globe and Mail the video was shared “as a practical joke.”

Paul Walker’s daughter feels betrayed

Paul Walker’s daughter reportedly feels ”betrayed” by her grandmother.

The late star’s mother Cheryl Ann had dropped her petition to become legal guardian of 15-year-old Meadow after reaching an agreement out of court with the teenager’s mother Rebecca Soteros, but a court has refused to dismiss the case.

Appointing an attorney for Meadow and ordering an investigation into her care, Commissioner David Cowan said yesterday (04.30.14): ”It is up to the court to decide whether guardianship case should be granted or denied.”

And Meadow – who had been staying with Cheryl Ann when her father was killed in car crash – is said to feel ”betrayed” that her grandmother applied for guardianship without consulting her, arguing Rebecca had an alcohol problem and was unable to care for the teenager, and is also ”hurt and unhappy” that she wasn’t told her dad’s brothers Cody and Caleb will appear in ‘Fast & Furious 7’.

Meadow, who moved to California from Hawaii in 2011 to be closer to her father is currently staying with a family friend but wants to move back in with her mother.

A source told E! News: ”Meadow is doing well and still in school and spending time with her friends like any teenager.

”She soon hopes to move into a new home in the LA area with her mom.”

It was previously reported that Cheryl had promised to abandon her custody bid if Meadow’s mother sought treatment in rehab for her ”serious drinking problem”.

Rebecca promised to check into rehab immediately and also agreed to regular drug testing after completing her stint as being with Meadow is the ”most important thing” to her.

The youngster is set to inherit Paul’s entire fortune of a reported $25 million after he named her as the sole beneficiary in his will.

The star also appointed his father, Paul Walker Sr., as the executor, and stated that Cheryl should become Meadow’s legal guardian.
