‘Definitely a lawsuit’: Virginia woman goes to Wendy’s. Then she sees something pink in her chicken sandwich

There are few things more disappointing than putting everything on hold to get some fast food, picking up an order, and noticing something about the food is… off.

One woman is viral for experiencing such disappointment after purchasing a Wendy’s chicken sandwich. And some of her viewers are calling it grounds for legal action.

‘This was unacceptable’

Musician and content creator Shuntell Diverse (@shuntelldiverse), who also uses the music alias “Trap Tina,” posted a video of a verbal confrontation she experienced with Wendy’s employees over her sandwich order. The video has accumulated more than 100,000 views.

Shuntell’s video began with her entering a Wendy’s while filming. She overlaid the words, “Count your days Wendy’s” onto the post.

“That’s why y’all was looking at me like that?” Shuntell asked the employees as she walked in. “I need my money back.”

She began explaining the issue with her sandwich to the employees.

“This sandwich not even done,” Shuntell said, opening up her chicken sandwich to reveal a gray and pink interior. “That’s why I was looking at me like that. Look at the sandwich … It’s not okay.”

She asked for a refund, and one Wendy’s worker responded, “Okay.” The workers began making Shuntell a replacement sandwich. As she waited, she remarked that the situation was “crazy as [expletive].”

When a manager came to the counter, Shuntell asked her to actually take a closer look at the sandwich she’d been served.

“Do you see that?” Shuntell asked. “Can you look at it? Because that’s crazy … Can you take a look at that and let me know if that is acceptable or not?”

The manager responded, “No, it’s not.” With that, Shuntell thanked her for acknowledging the situation, and left.

“Mind you I don’t like altercation but this was unacceptable,” Shuntell wrote in her caption. “Second order made and while heading out the store the whole crew was [staring] at me looking suspicious asf so I asked why they looking at me and now I see why .. count your [expletive] days Wendy’s.”

Is undercooked chicken grounds for a lawsuit?

Shuntell’s viewers flooded her comment section with calls for legal action, with many of them expressing disgust for Wendy’s chicken.

“Wendy’s use to be a solid choice for fast food, they fell off tremendously,” one person said.

“I got food poisoning from Wendy’s like 7-8 years back and have never eaten there again,” another wrote.

“Wendy’s fall from grace needs to be studied,” a third commented. “They used to be so good.”

Multiple people asserted that Shuntell’s situation was “definitely a lawsuit” waiting to happen, and others also advised her to contact her local health department. So what is the actual correct protocol here?

In general, legal experts note that without a physical injury such as food poisoning, it’s difficult to make a civil claim.

It is indeed a good idea, however, to report being served undercooked chicken to one’s local health department, as the CDC reports that “if you eat undercooked chicken, you can get food poisoning.”
